Ultimate Tennis League Participant Waiver and Assumption of Risk
In consideration of the services provided by Ultimate Tennis, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree, represent and warrant that:
A. Waiver and Assumption of Risk:
- I understand tennis entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, but are not limited to: Slipping and falling; exhaustion; temperature exposure; collision with or being hit by other tennis players; striking obstructions; equipment failure; adverse weather conditions; serious injury to bones, joints, ligaments, muscles, tendons and other aspects of the neurological system, vascular and/or musculoskeletal system
- I have voluntarily registered to participate in the Ultimate Tennis League. I expressly agree and promise to accept all of the risks existing in this activity, and I elect to participate in spite of the risks.
- I have consulted with physicians and other medical advisors and, taking into account their advice have made my own determination whether I will engage in tennis.
- I have adequate insurance to cover any injury or damage I may cause or suffer while participating in Ultimate Tennis, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
- I am solely responsible for evaluating each facility I play at to ensure it meets my standard of safety and playability. I understand by playing the match, I agree to do so at my own risk and release Ultimate Tennis as well as any host facility of any liability for injuries arising from my participation.
B. Covenant Not to Sue: I, my heirs, executors, administrators, guardians, legal representatives and assignors, exempt and release Ultimate Tennis, their officers, directors, agents, employees, representatives, servants or shareholders, nor to initiate or assist the prosecution of any claim for damages or cause of action which I, my heirs, executors, wards, principals or administrators hereafter may have by reason of injury to my person or to my property director or indirectly arising from or related to my participation in the Ultimate Tennis League.
C. Indemnity Against Claims: I hereby agree that, my heirs, executors, administrators, guardians, legal representatives and assignors will indemnify, save and hold harmless Ultimate Tennis conducted from any and all losses, claims, actions, or proceedings of every kind which may be presented or initiated by any persons or organizations arising directly or indirectly from my participation in Ultimate Tennis.
